Orca Learning Ltd ("Orca Learning", "we", "our", or "us") provides healthcare education, workforce development, leadership development, organisational development consultancy, simulation-based education, and continuing professional development (CPD) activities.

By accessing our website, purchasing a course, creating an account, or using our services, you agree to be bound by these Terms and Conditions.
If you do not agree with these Terms, you should not use our services.


2. Eligibility

By creating an account, you confirm that the information you provide is accurate, complete, and up to date.

4. Course Access and Licences

When you purchase a course, you are granted a limited, non-transferable licence to access the course content for the period specified at the time of purchase.
Access periods may vary between products.
Course access may be withdrawn if these Terms are breached.
Orca Learning reserves the right to update, improve, amend, or remove content where necessary to maintain accuracy, quality, or compliance with current practice.


5. Payments

All prices are displayed in Pounds Sterling (£) unless otherwise stated.
Payment must be made in full before access to paid content is granted unless alternative arrangements have been agreed.
Payments may be processed through trusted third-party providers including PayPal and Stripe.
Orca Learning does not store payment card details.

6. Cancellation and Refunds

Consumers may have certain rights under UK consumer protection legislation.
Where a course or other digital content is purchased, access is typically provided immediately following payment. By purchasing and accessing digital content, you acknowledge that delivery of the digital service begins immediately.
In accordance with applicable consumer legislation, your right to cancel may be lost once the supply of digital content has commenced.
Except where required by law, refunds will not normally be provided for digital products, online courses, downloadable resources, or learning content once access has been granted.

Nothing in these Terms affects your statutory rights.

7. Intellectual Property

All course materials, videos, graphics, documents, assessments, educational resources, branding, and website content remain the intellectual property of Orca Learning or its licensors.
You may access materials for your personal learning and professional development only.

You may not:

- Share access credentials
- Distribute course materials
- Record, download, or republish content unless expressly permitted
- Use course materials for commercial purposes without written consent

Unauthorised use may result in account termination and legal action.


8. Certificates and CPD Records

Certificates may be issued upon successful completion of specified course requirements.
Certificates confirm participation in and completion of a learning activity.

Certificates do not constitute:
- Professional registration
- Professional accreditation
- Clinical competency assessment
- Authority to undertake clinical duties

Learners are responsible for maintaining their own CPD records and ensuring compliance with relevant professional and regulatory requirements.


9. Educational Disclaimer

Orca Learning provides educational content for learning and professional development purposes.

Our content is not intended to replace:
- Professional judgement
- Clinical supervision
- Local policies and procedures
- Professional standards
- Regulatory requirements

Healthcare professionals remain responsible for exercising their own professional judgement and complying with applicable laws, standards, and employer requirements.
Nothing within our courses should be interpreted as patient-specific medical advice.


10. Consultancy and Organisational Services

Where consultancy, organisational development, workforce development, simulation, or bespoke educational services are provided, additional contractual terms may apply.
Where services are supplied under a separate agreement, purchase order, framework agreement, or contract, the terms of that agreement shall take precedence where any conflict exists.

11. Acceptable Use

You agree not to:
- Use the platform unlawfully
- Upload malicious software
- Attempt unauthorised access to systems
- Harass other users
- Post offensive, discriminatory, or unlawful content
- Interfere with the operation of the platform

We reserve the right to suspend or terminate accounts where these requirements are breached.
